forgot to mention the clerk that looked up the warranty extremely rude and would not even listen to our talking just nope nope nope is all he said nope nope nope can't help you because you didn't get it done here nope nope nope. I'm just not sure how to proceed with this should I call Sears and fight Guardsmen what should i do help? the tires were only $70 a piece once we applied a coupon so do I go to the fight and is it going to be worth it since now I have to buy 4 new tires instead of just two more. I'm not sure if the other tire is defective but why would I want a guardsman tire on my car now?
Unless it was damaged by the other shop mounting the tire they have no right to refuse your claim. I would seek out the store manager and if he can't explain why the claim is not valid and still refuses to make good I would take it to a higher level. I believe you can read the warranty and there will be no mention of them having to do the mounting.
dont mess around, as was posted goto the general manager of the shop, firmly w/o being abrupt present your demands which could include more reimbursement than just the tires considering the unprofessional service and probably defective product you got from Sears.
If S gives you any guff, goto small claims where you'l prob be awarded a judge for more $ than just the tires,
IF S doesnt contact you b4 trial and offer you a deal.
The Magnuson Moss Act says that SEARS must prove that the damage was caused by improper installation. They cannot revoke the warranty simply because you had someone else install them. There has to be cause and effect. Skip the service guys and go right to the store manager. Tell him you know what Magnuson Moss has to say about warranties.
Virtually any dealings I've had with SR over the past 10+yrs. has had some kind of Sears-based screw up. My god the morons they hire to work there these days is beyond belief. Of course I could gripe about literally all store employees ie Lowes,Fry's etc. but those lazy dumb *** slackers at Sears are the worst. Oh, and I agree with the people who said go straight to the manager and do quote that Magnuson-Moss Act, it can't hurt.
Did you read through the warranty terms and conditions before signing it. If you had, you would have realised that it was only valid if Sears fitted the tyres, and would not have bought it. I doubt you will get anywhere trying to get a refund - because the tyre was fitted by someone else Sears can claim that any damage may have been done when the tyre was fitted, and will therefor deny their liability. You cannot now prove that the tyre was faulty when you bought it, nor can you prove that it was damaged when fitted.
At the very least they should refund the money they gypped you out of for the non existent warranty they sold you. And Yes he is an azzz I wonder what they tell people who show up that need help that are traveling and didn't buy the tires there.....

so a month ago we bought two tires from Sears automotive Guardsman tires, we live in an area where there are a lot of tire repair shop so we asked can we have it mounted ourselves we purchased the tires and walked out of the store with them. we never once discussed details of the warranty but the clerk was very persistent in selling us the tire with the warranty. he even signed us up for the rewards program great customer service and sale...we recently had a tire wobbling problem and we went to another tire shop and they told us that our tire is defective that we need to return them to Sears and he said if I touch it I will void any warranty so go ahead and go there first. we went to Sears and they looked up the paperwork and they said that the warranty will not cover the product because we carried it off site and they did not balance or mount or do any of the tire work themselves. we have been mounted rotated and balanced by legitimate tire business . the back of the warranty receipt shows that it is a product warranty not a service warranty so why can I not get my money back for my tires that another tire repairman said the tire was bad defective and weak to be new.
