If you are traveling in a lane and someone enters that lane and causes an accident it's the other drivers fault for failure to yield. Regardless of what they are doing (turning, backing out of a driveway, leaving a parking lot, etc...) that is your lane and they must base their actions on allowing you to safely proceed traveling in that lane.
