Bought a car from an owner that did not pass smog.?

Nope. You bought it as is. Why anyone would think that a spark plug change would be the only thing needed to pass a smog check? Why would anyone buy an automobile that didn't have a current smog cert? You can certainly sue him and be told by the judge the same thing. Yer S.O.L.

The seller was correct. It may have worked perfectly fine, while failing the smog test. The smog test has nothing to do with the functioning of the vehicle. It has to do with the extent of emissions coming from it. The state wants to keep the air as clean as possible and has a limit on the extent of emissions allowed.

Since the car was purchased "used", it was purchased "as is", without any warranties. Unless you have a Bill of Sale/Contract that provides you with a warranty, you have no claim against the seller.

as im undertanding u took the car as is. therfore u wouldnt be able to sue him. unless u had it in writing that he would pay for anything thats wrong with the car and had a witness, there really isnt much u can do. u shoulda had him smog it before u bought it. and seen the radiater leaking. but shoulda coulda woulda. best of luck man, hope u get some kind of justice. considering u threw what a $ k + into the car. hate sneaky/dis honest people with a passion. *** probably new all that was wrong with it to.

Read this post on buying a used car. You pretty much broke every rule in the book. The seller has no obligation to pay you. None.

Caveat Emptor.

look up your state law on passing a smog test from the seller.

the rest of your repairs are on you,you bought it "AS IS"

You are responsible to check all that out before you buy it. Education costs money. You just paid for some.

No you can not sue you brought the car as is he is not required to repay you for the parts you put into it

So now you know; never believe a seller. Class dismissed.

I bought a car that was supposed to have its spark plugs replaced then it would pass the smog. I changed the plugs then went to smog it it didnt pass due to the catalytic converter being smashed. I changed it then went and smogged it and passed. I told the owner anything i spent you will pay me back he didnt reply to the text. Anyway, he told me the AC system needs recharging and it will work perfectly fine. I recharged it, couple hours it was hot again. I replaced the hose. The radiator had leak in it i replaced it. Then I was driving and the clutch master cylinder went out i replaced it. The total came to be over $1000. Im messaging and calling him but hes not picking up. What can I do? I read i could sue him to court but waned more info. Thank you
